What is LoadHub

Which type of companies can use the LoadHub platform?

The LoadHub platform can be used by all companies involved in the transport of goods subject to the RO e-Transport system, regardless of their role in the logistics chain.

LoadHub is suitable for:

  • Declarants (importers, exporters, beneficiaries, suppliers, or depositaries)

  • Transporters with their own fleet

  • Forwarding companies, with or without a fleet

  • Carriers who perform the actual transport

  • Companies involved in national or international transport that are monitored through RO e-Transport

  • Foreign transporters and European forwarding companies

As a Transporter, how can I start using the LoadHub PLATFORM?

If you are a Transporter, you can start using LoadHub by following these steps:

  1. Create a company account on the LoadHub platform.

  2. Choose a subscription: Transporter or Transporter+.

  3. Connect your ANAF token during your first login.

  4. Retrieve your UIT codes where your company is declared as a Transporter – either from the SPV or enter them manually if your company is not listed.

  5. Connect your GPS provider or use the LoadHub Driver mobile app for GPS monitoring.

  6. Create user and driver accounts.

📱 Driver instructions:
Your driver installs the LoadHub mobile app for free on their phone. They automatically receive the UIT codes or LoadPins and can start/stop GPS monitoring according to their route. Drivers can also upload the CMR and complete the trip directly from the app.

Note: LoadHub helps you fulfill your legal obligation for GPS transport monitoring without generating or modifying UIT codes on your behalf.

How do I start using the LoadHub app if I am a Declarant?

If you have the role of Declarant, you can use LoadHub as follows:

  1. Create a company account on the platform.

  2. Choose a subscription: Declarant or Declarant+ (if you also transport with your own fleet).

  3. Connect your ANAF token during your first login.

  4. Retrieve UIT codes from the SPV (created in other accounting SPVs) or generate them using one of the three methods available in LoadHub.

  5. Collaborate with Transporters and Carriers involved in the transport who are also using LoadHub.

  6. Create accounts for Romanian or foreign subcontracted drivers to assist them with ANAF-required monitoring, while being able to track the location of goods on the map.

  7. Modify, confirm, or manage UIT codes as needed.

If you have your own fleet, with the Declarant+ subscription, you can connect your GPS provider and monitor the location of goods for ANAF compliance, all from the same account.

How do I use the LoadHub app if I am a Driver?

Drivers can use the LoadHub mobile application in the following situations:

  • When there is no traditional GPS device installed on the vehicle.

  • When the vehicle’s GPS system is not integrated with LoadHub.

  • When the company chooses to use the mobile app as an alternative monitoring solution.

Driver accounts are created exclusively by the company representative via the web platform. The mobile app enables drivers to:

  • Automatically receive active UIT codes assigned to their vehicle.

  • Perform GPS monitoring of transports.

  • View assigned UIT codes.

  • Transmit necessary information to ensure compliance with legal requirements.

Can LoadHub replace a classic GPS system?

Yes, but only in certain situations.

The LoadHub Driver mobile app can serve as an alternative to a traditional GPS when:

  • The vehicle does not have a dedicated GPS device.

  • There is no integration available with the existing GPS system.

  • A quick solution is needed to avoid installing additional hardware.

Note: LoadHub also supports the integration of existing GPS systems.

CAN I CONNECT LOADHUB WITH THE GPS SYSTEMS ALREADY INSTALLED ON THE COMPANY'S VEHICLES?

LoadHub allows integration with existing GPS systems through compatible GPS service providers.

  • Monitoring start/stop is controlled via the platform or the mobile app.

  • Location data is automatically transmitted to ANAF.

Note: Integration availability depends on the GPS provider used by the company.

Can foreign companies from outside of Romania use the LoadHub platform?

Foreign companies can use LoadHub if they are involved in transports subject to RO e-Transport legislation, including:

  • International transports with an entry or exit point in Romania.

  • Collaborations with Romanian companies acting as Declarant or Transporter.

Note: Access and available features depend on the company’s role in the transport.

Can foreign drivers use the LoadHub Driver app?

Foreign drivers can also use the LoadHub Driver mobile app, subject to the following conditions:

  • They must have a driver account created by the company managing or contracting them.

  • The transport must be monitored in accordance with RO e-Transport requirements.

  • The app must be used on a compatible device.

The LoadHub Driver mobile app is available in English. UIT codes appear in the app once they become active, and location monitoring to ANAF starts automatically when the vehicle enters Romania.

From where can I download the LoadHub Driver mobile app?

The LoadHub Driver mobile app is available for free on:

  • Google Play (Android)

  • Apple App Store (iOS)

Simply search for “LoadHub Driver” and install the app on the driver’s phone.

Do you need to have an internet connection on your phone to use the LoadHub driver app?

Internet connection requirements:

The LoadHub Driver app requires an internet connection to transmit GPS data to ANAF.

  • If there is no connection, the data is saved locally on the device.

  • Once the phone reconnects to the internet, the data is automatically transmitted.

LoadHub Plans, Registration and Users

Which LoadHub subscription fits my needs?

Choosing the right LoadHub plan depends on your company’s role in the RO e-Transport system and the volume of transports:

  • Transporter – For transport companies with a fleet of fewer than 10 vehicles that need GPS-based transport monitoring.

  • Transporter+ – For forwarding companies or transport companies that subcontract.

  • Declarant – For companies responsible for declaring transports (importers, exporters, beneficiaries, suppliers, depositaries).

  • Declarant+ – For companies with dual obligations, such as generating UIT codes and monitoring transports performed with their own fleet.

Note: The “+” subscriptions provide extended access for more users and additional features.

How do I create a LoadHub account?

How to create a LoadHub account:

  1. Go to the registration page: https://app.loadhub.ro/inregistrare/detalii-cont

  2. Fill in your company details.

  3. Confirm your email using the message you received.

  4. Choose the appropriate plan.

  5. Log in to the platform and complete the initial account setup, including connecting your digital signature token.

Depending on your company type, you can also integrate your fleet’s GPS system with LoadHub during this setup.

How do I resume the registration process if I abandoned it at some point?

Resuming an abandoned registration:

  • You can resume registration by entering the email you used during the initial registration.

  • The platform will guide you to the step where you left off.

  • If you cannot find the email in your inbox, please contact a LoadHub representative to continue the registration process.

What types of users are there in LoadHub plans?
Can I add multiple users to the same business account?

LoadHub user types vary depending on your plan:

  • Account Manager – The primary user for all subscriptions.

  • Dispatcher – Available for Transporter subscriptions.

  • Commercial Declarant

  • Logistics Declarant

  • Driver – Managed via the mobile app.

Yes, you can add multiple users to the same company account, up to the limit allowed by your plan.

What are the differences between the types of users: account manager, dispatcher, commercial declarant and logistics declarant?

User role access in LoadHub:

  • Account Manager – Full access to settings, users, subscriptions, and general configuration.

  • Dispatcher – Manages shipments and GPS monitoring, without access to sensitive settings.

  • Commercial Declarant – Handles commercial transport data, including partners and documents.

  • Logistics Declarant – Manages operational aspects, such as maps, vehicles, and transport statuses.

Note: Access for each role is limited according to its responsibilities.

Can I use the same LoadHub account for multiple companies?

Each LoadHub account is linked to a single legal entity.
If your organization manages multiple companies, a separate account must be created for each company.

What is the minimum contract period for LoadHub plans?

LoadHub plans are renewed every 30 days and do not require a long-term contract.
You can cancel your plan at any time via the Settings section of your account, in accordance with the applicable terms and conditions.

What happens if I forget my password?

Forgot your password?

  1. Click on the “Forgot your password” link.

  2. Enter your email address.

  3. Check your email and follow the instructions to reset your password.

  4. Set a new password and log in to your account.

If I'm using LoadHub, do I still need to use the SPV or the RO e-Transport monitoring platform?

No. You can perform all SPV e-Transport or RO e-Transport monitoring actions in one place using LoadHub.

If I'm already using the ANAF app, what advantages would LoadHub bring me?

In LoadHub, you can perform all the same actions as in the ANAF application, with several additional features:

  • Simultaneous GPS monitoring for multiple UIT codes (useful for mixed or groupage shipments).

  • Automatic GPS monitoring start without driver intervention when GPS coordinates for the start and end addresses are provided.

  • Automatic GPS monitoring start for all UIT codes before the truck enters Romania.

  • Automatic reminders to stop monitoring – the app notifies the driver to close monitoring if GPS coordinates exist.

  • Control of GPS monitoring – dispatchers can start/stop from the web platform, or drivers can do it via the mobile app.

  • Upload of confirmed CMR and cargo receipt documents upon trip completion.

  • Centralized management of all UIT codes, including codes in which the company is not listed.

Integration with SPV (ANAF's Virtual Private Space) and digital certificate authorization

What is a digital certificate (token) and why is it needed?

A digital certificate (often called a “token”) is an authentication tool issued by an authorized provider that allows a company to be identified in electronic interactions with ANAF.

The digital certificate is required for:

  • Accessing the Virtual Private Space (VPS).

  • Declaring transports in the RO e-Transport system.

  • Generating, modifying, and confirming UIT codes.

By connecting the digital certificate to LoadHub, your company can transmit and receive data strictly related to ANAF e-Transport.

How do I authorize the digital certificate (token) on the platform?

Token authorization is performed directly from your LoadHub account:

  1. Go to Account Settings

  2. Select ANAF Token Settings

  3. Click on Token and follow the instructions to authorize your digital certificate

Does the digital certificate (token) need to be periodically reauthorized in the LoadHub platform?

The digital certificate (token) must be reauthorized annually, as required by ANAF, or in the following situations:

  • Certificate expiration

  • Replacement of the certificate with a new one

  • Revocation or modification of rights in the SPV

  • Changes imposed by ANAF systems

Note: Reauthorization is required to ensure that the SPV integration remains functional.

Can I replace the existing token with another one?

Yes. The digital certificate must be reauthorized in the following situations:

  • Certificate expiration

  • Replacement with a new certificate

  • Revocation or modification of rights in the SPV

  • Changes imposed by ANAF systems

Note: Reauthorization is required to keep the SPV integration functional.

What does "import from SPV" mean?
Which UIT codes can be imported?

“Import from SPV” refers to the transfer of UIT codes associated with your company from ANAF’s Virtual Private Space (SPV) into LoadHub.

When importing from SPV, the following can be transferred:

  • Active UIT codes

  • Confirmed UIT codes

  • Rejected or expired UIT codes, within the limits of the information provided by ANAF

This import feature enables centralized management and visualization of all declared transports, even those initially generated in other software.

What do I do if the ANAF token shows an error during the import?

If you encounter difficulties connecting your digital certificate (token) to the LoadHub platform, follow these steps:

  1. Check the certificate validity – Ensure the token is active and valid. You can verify this via your certificate provider’s app (e.g., DigiSign, CertSign, TransSped).

  2. Verify the password – Errors may occur if the certificate password is incorrect or expired.

  3. Confirm correct token installation – Test by logging in directly to SPV via a browser: anaf.ro → RO e-Transport authentication.

  4. Check SPV permissions – The token must be enrolled in the company account and have rights for e-Transport services.

  5. Try another browser or device – Browser extensions or local settings can sometimes block loading the .pfx file.

If the issue persists, contact your digital certificate provider.

Note: LoadHub provides informational messages but cannot control ANAF system availability or behavior.

UIT code management

What is a UIT code and who is required to have it?

A UIT code is a unique transport identification code generated through ANAF’s RO e-Transport system, used to monitor the transport of goods subject to legislation.

The obligation to obtain a UIT code depends on the type of transport and falls on the Declarant, which may be:

  • Importer

  • Exporter

  • Beneficiary

  • Supplier

  • Depositary

LoadHub assists users in managing UIT codes, but does not assume the legal responsibility for declaring them.

What goods are subject to the RO e-Transport system monitoring and to the UIT code generation?

Goods monitored through RO e-Transport:

  • Goods with high fiscal risk, as defined by ANAF.

  • All goods transported internationally, regardless of fiscal risk.

For a detailed list of high fiscal risk goods, please refer to the official ANAF documentation.

How can I generate a UIT code directly from LoadHub?

Creating a new transport / generating a UIT code

  1. Navigate to UIT Management → New Transport.

  2. Fill in the required information.

Note: LoadHub assists in the process but does not generate UIT codes independently of ANAF.

For how long does a UIT code remain valid?

Validity period of a UIT code:
  • Intra-Community Acquisition (AIC): 15 calendar days.

  • All other types of transport: 5 working days or 7 calendar days, starting from the declared transport start date.

Important: Road transport operators are prohibited from using a UIT code beyond its validity period.

When do I need to obtain the UIT code?

When to generate a UIT code:

  1. National transport – Required only for:

    • Goods with high fiscal risk (HFRG),

    • Transported by vehicles with MTMA > 2.5 tons,

    • And if the transport exceeds 500 kg or 10,000 lei.

  2. International transport – Required for all goods exceeding 500 kg or 10,000 lei, including:

    • Import

    • Export

    • Intra-community acquisitions (AIC)

    • Intra-community deliveries (LIC)

    The code must be generated before the vehicle arrives at the border crossing into Romania.

Note: The UIT code can be obtained up to 3 calendar days before the declared transport start date.

Can I import UIT codes that have already been declared in SPV before using the LoadHub platform?

Yes, LoadHub allows you to import existing UIT codes from SPV, including those declared before using the platform, enabling centralized management of all transports.

Note: The import is limited to the information provided by ANAF through SPV.

Can I edit a UIT code after it has been issued? What data can be modified?

According to legislation, only certain data can be changed after a UIT code has been issued.

  • Allowed modification: Vehicle identification (registration number) during the code’s validity period.

  • Other changes: Require invalidating the UIT code and re-declaring the transport.

Can I delete an already issued UIT code?

No. UIT codes that have already been issued cannot be deleted.

The only legal option is to invalidate the UIT code following the procedures established by ANAF.

What types of transport must be declared in the RO e-Transport system: national transport, international transport, imports, or intra-community acquisitions of ordinary goods or goods with high fiscal risk?

Transports that must be declared in RO e-Transport:

  • National transport of high fiscal risk goods

  • International transport, regardless of the type of goods

  • Imports

  • Exports

  • Intra-community acquisitions (AIC)

  • Intra-community deliveries (LIC)

  • Transits, under the conditions provided by law

Do you need to generate a UIT code and report the GPS location for goods that are transiting Romania?

No. According to legislation, if the goods are only transiting through Romania without unloading or consolidating on Romanian territory, a UIT code is not required.

What is a LoadPin?

A LoadPin is a code generated by LoadHub that groups one or more UIT codes being transported by the same vehicle.

  • UIT codes remain the legal ANAF identifiers.

  • The LoadPin is an operational tool within LoadHub.

  • It simplifies GPS monitoring and management of multiple simultaneous transports.

GPS Monitoring

How is the GPS data monitored and transmitted to ANAF in LoadHub?

GPS data can be transmitted to ANAF through LoadHub using one of the following methods:

  1. Integration with an external GPS system – If the vehicle is already equipped with a compatible GPS device connected to LoadHub.

  2. LoadHub mobile app – Used by the driver when there is no integrated GPS or the GPS is not available.

Monitoring process after activation by dispatcher or driver:

  • LoadHub collects the vehicle’s GPS positioning data.

  • The data is automatically transmitted to ANAF RO e-Transport, in accordance with legal requirements without manual intervention.

  • Reporting continues throughout the transport until completion.

Note: LoadHub acts as a technical intermediary between the GPS data source and ANAF systems, within the limits of applicable legislation and ANAF system availability.

What happens if the driver changes during transit?

The Dispatcher or Account Manager must make this modification on the LoadHub web platform to update the driver during transit.

What happens if the tractor unit or semi-trailer number changes during transit?

Changing the vehicle number during transport

  • The modification must be declared in accordance with RO e-Transport legislation.

  • The change is made by updating the vehicle data in LoadHub.

  • GPS monitoring continues on the new vehicle once the update is applied.

Note: LoadHub assists in this process within the limits allowed by ANAF systems.

What do I do if a driver forgets to activate the GPS monitoring through the LoadHub app?

If GPS monitoring has not been activated:

  • Monitoring can be started manually as soon as the situation is noticed.

  • It is recommended to activate monitoring before the vehicle sets off.

Important: Compliance with the legal obligation remains the user’s responsibility, as per legislation.

The GPS monitoring status is visible on the LoadHub web platform. The transport organizer’s representative should check the status regularly and take immediate action to activate monitoring if needed.

What happens to GPS tracking if the driver temporarily leaves the unloading location (e.g. over the weekend or overnight)?

If the transport has not been completed:

  • GPS monitoring can remain active, or

  • It can be resumed later, depending on the situation and platform configuration.

Important: The transport should only be marked as completed after the final acceptance of the goods.

What happens if i lose the GPS signal during the route?

If the GPS signal is temporarily lost:

  • The GPS application or system will resume transmitting the position once the signal returns.

  • This behavior is standard for GPS technology.

Note: LoadHub cannot control GPS coverage.

What happens if the internet connection is lost en route?

If there is no internet connection:
  • GPS data can be temporarily stored on the device.

  • Transmission resumes automatically once the connection is restored.

Note: If using the LoadHub Driver mobile app, the app must remain active for monitoring to continue.

Payments and billing

How is the subscription invoice issued?

LoadHub plan and billing:

  • After creating an account, you can test the platform for free for 7 days.

  • To continue using LoadHub after the trial, you must choose a payment method.

  • The invoice for the subscription is issued automatically upon activation and every 30 calendar days thereafter.

  • Payment is made automatically via the chosen method (e.g., credit/debit card), and the tax invoice is generated upon successful settlement.

Aside from the monthly plan, are there any additional costs for using the LoadHub app?

In addition to the monthly plan, users may incur extra costs for:

  • Exceeding plan limits, such as the number of UIT codes or storage space.

  • Optional services, such as GPS provider integration or the automated monitoring start/stop feature.

Note: All costs are clearly communicated on the platform and in the commercial documentation.

How do I change my subscription?

Plans can only be upgraded.
To upgrade, contact a LoadHub representative via email or the support chat.

How do I suspend a subscription?

Only the Account Manager can suspend a plan:

  1. Log in as Account Manager.

  2. Tap your name and go to Account Settings.

  3. Select the Subscriptions & Billing tab.

  4. Tap “Suspend Subscription”.

Integration with GPS providers and external software

Can I connect LoadHub with the GPS systems that are already installed on company vehicles?

LoadHub allows connection with already installed GPS systems through integration with compatible GPS providers.

  • GPS data is automatically retrieved.

  • No driver intervention is required via the mobile app.

  • Monitoring is conducted in accordance with RO e-Transport requirements.

Note: Integration availability depends on the GPS provider used by the company.

Is LoadHub a fleet monitoring solution?

LoadHub is designed as a compliance infrastructure for RO e-Transport, focusing on:

  • Monitoring transports strictly in the context of legal obligations.

  • Transmitting GPS positions to ANAF in accordance with current legislation.

  • Facilitating collaboration between Declarants, Carriers, and Drivers.

Note: LoadHub features do not replace dedicated fleet management solutions (e.g., fuel consumption, driving style analysis, advanced reporting).

If I'm already using a GPS provider, do I still need to use LoadHub for e-Transport?

LoadHub does not replace the features offered by your GPS provider, but it ensures compliance and control over the mandatory monitoring of goods under e-Transport.

Compared to most GPS providers, LoadHub offers additional features, including:

  • Centralization and management of all UIT codes (automatic import from SPV, including codes where your company is not listed as a transporter).

  • Simultaneous modification of the vehicle number across all UIT codes in a cargo group.

  • Integration with all fleet GPS providers.

  • Integration with Volvo Telematics.

  • Automatic start of GPS monitoring upon entry into Romania.

Note: Using LoadHub does not require changing or giving up your current GPS provider. LoadHub currently collaborates with multiple GPS providers in Romania and across Europe. The “e-Transport powered by LoadHub” service is also offered to GPS providers that have not yet developed this feature.

is possible to integrate the ERP or TMS platforms used by the company?

Depending on the system used and the company’s requirements, LoadHub can be integrated with ERP or TMS platforms.

LoadHub can operate:

  • Independently, as a standalone compliance platform.

  • Integrated into an existing IT ecosystem via API.

Note: Integration details are determined case by case, based on operational and technical requirements.

Does LoadHub offer the option of integrating via an external API?

Yes, LoadHub supports integrations via API, subject to the availability and access policy defined by the platform.

APIs can be used for:

  • Integration with GPS systems

  • Operational data exchange

  • Automation of internal workflows

Note: API availability and access level are determined by contract.

Why won't all of my UIT codes appear on the platform?

Possible reasons for some UIT codes not being visible in LoadHub include:

  • UIT codes have not yet been imported from SPV.

  • ANAF systems are temporarily unavailable.

  • UIT codes were declared for another legal entity.

  • Limitations exist in the data provided by ANAF through SPV.

  • The validity period of the UIT code has expired.

Note: LoadHub displays UIT codes based on the information provided by ANAF and cannot fully control their availability.

Legislation and RO e-Transport responsibilities

Who is obligated to declare the transports in RO e-Transport?

In the context of RO e-Transport legislation, the “obligation to declare the transport” refers to entering the required data in the RO e-Transport system and generating the UIT code. This responsibility falls on:

  • Supplier – for domestic transport

  • Beneficiary in Romania – for intra-community acquisitions (AIC)

  • Sender in Romania – for intra-community deliveries (LIC)

  • Depository – for goods in transit or in groupage

  • Importer/Exporter – for goods entering or leaving the EU. Specifically: the recipient listed in the import customs declaration or the sender listed in the export customs declaration, for goods with high fiscal risk subject to import/export operations, as applicable.

The declaration can be made:

  • In the company’s own name, or

  • By a legal representative, a designated representative, or an authorized person, in accordance with Art. 2, paragraph (2) of the Procedure for use and operation approved by ANAF Order no. 1337/2024.

Who is obligated to report the GPS position in the RO e-Transport system?

The obligation to report GPS positioning data falls on:

  • The road transport operator – the company that physically carries out the transport using its own vehicles;

  • The transport organizer – forwarding companies, companies using their own fleet for self-transport, as well as distributors or suppliers that directly organize the delivery of goods to clients;

  • The vehicle operator (driver) – responsible for activating the GPS device before departure and deactivating it only after delivery on Romanian territory or after exiting the national territory, as applicable.

Note: If a forwarding company acts as the transport organizer, it becomes responsible for ensuring GPS monitoring by issuing orders and concluding contracts that include explicit clauses obligating subcontractors to install and use compliant monitoring solutions, such as the LoadHub application.

Which vehicles are subject to the obligation of declaring in RO e-Transport?

The following vehicles are subject to the declaration obligation:

  • Road vehicles transporting goods that fall under the RO e-Transport system;

  • Vehicles used for national transport of goods with high fiscal risk;

  • Vehicles used for international transport, including transit operations.

Note: The obligation applies as established by legislation, regardless of the vehicle’s tonnage or ownership.

Can we combine multiple shipments from different suppliers?

It is possible to have multiple shipments from different suppliers in the same vehicle. This applies in these situations:

  • Each batch of goods must be declared separately.

  • Each shipment must have its own UIT code.

  • GPS monitoring must be performed for the entire shipment.

Is a UIT code necessary if the shipment is made by courier?

Generally, courier service providers are not required to declare shipments in RO e-Transport. However, the obligation falls on the beneficiaries or suppliers if the goods are high fiscal risk (HFRD) and exceed the established thresholds. In such cases, they must obtain the UIT code and communicate it to the courier before the vehicle begins the transport.

Who updates the UIT code in case of malfunction/transshipment?

Updating the UIT code is performed by the person obligated to declare, namely the Declarant or the Transport Organizer, as required by legislation.

In the event of a malfunction or transhipment:

  • The vehicle data must be updated.

  • The update must be performed before resuming the transport.

How are shipments declared in the case of groupage or multiple consignments of goods?

In the case of groupage:

  • Each batch of goods must be declared separately.

  • A UIT code must be generated for each batch.

  • GPS monitoring must be performed for the vehicle transporting the goods.

What does "HFRG consignment" mean?

Consignment of goods is a technical term defined in Art. 2, point 5 of GEO no. 41/2022 and refers to an indivisible set of goods that has:

  • The same place of loading and unloading

  • A single user responsible for the declaration (according to Art. 8)

  • A single final recipient

  • Goods transported by a single means of transport (even if the vehicle may change along the route)

🔹 HFRG (High Fiscal Risk Goods) are goods identified as high fiscal risk under ANAF Order no. 802/2022, such as:

  • Vegetables and fruits

  • Alcoholic beverages

  • Clothing and footwear

  • Metal constructions

  • Petroleum products, etc.

📌 HFRG batch is defined as a set of high fiscal risk goods transported as a unit under the same route, recipient, and sender conditions, which:

  • Exceeds 500 kg or 10,000 RON gross value, and

  • Is subject to monitoring and requires obtaining a UIT code

What happens if a HFRG transport is not declared as such?

Failure to declare the transport of high fiscal risk goods (HFRG) attracts sanctions under Article 13‑1 of GEO 41/2022(note: Art. 13 para. (1) was repealed, while Art. 13‑1 remains in force):

  • Natural persons: 10,000 – 50,000 RON

  • Legal entities: 20,000 – 100,000 RON

  • Drivers: 5,000 – 10,000 RON

  • In certain cases, additional sanctions may apply, including the gradual confiscation of the value of undeclared goods

What fines and sanctions can be applied in case of non-compliance with e-Transport obligations? What are the consequences of failing to declare a transport or of not having a UIT code?

The fines vary depending on the offense and the entity responsible:

  • Failure to declare the transport: up to 100,000 RON

  • Using an expired UIT code: up to 50,000 RON

  • Failure to activate GPS monitoring: 5,000 – 10,000 RON for the driver

  • Lack of a UIT code at the time of inspection: fine plus additional sanctions, including gradual confiscation of the goods

What sanctions apply in case of the confiscation of goods?

According to Art. 13¹ para. (5)‑(7) of GEO no. 41/2022:

  • For the second offense within 12 months, 15% of the value of the undeclared goods is confiscated.

  • For the third offense, 50% of the value of the undeclared goods is confiscated.

  • From the fourth offense onwards, 100% of the value of the undeclared goods is confiscated.

Does the transportation between two points of the same company (warehouse-store) require a UIT code?

This applies only if:

  • high fiscal risk goods are being transported, and

  • the statutory threshold of 500 kg or RON 10,000 per shipment is exceeded.

How is the transport declared in the case of returns or cancellation invoices?

The transport must be declared in the case of returns or cancellation invoices as follows:

  • If the goods are returned to the sender under the same UIT code, no new code is required.

  • If it is an actual return with a cancellation invoice and a new shipment, a new UIT code must be generated for the return, and in the remarks section, the mention return/cancellation invoice must be added.

 

Who is considered the "Transport Organizer" according RO e-Transport?

According to the definition set out in GEO no. 41/2022, Art. 2 para. (4), the transport organizer is:
“The economic operator that concludes the transport order directly with the road transport operator, or the economic operator that takes the order from the sender and transmits it to the transporter, as well as the economic operator or natural person that transports the goods in its own name.”

In practice, the following entities may be considered transport organizers:

  • Forwarding companies that conclude transport orders or transmit transport orders to the road transport operator
  • Companies that transport goods in their own name using their own fleet
  • Distributors or suppliers that directly contract the transporter and organize the delivery

What is the RO e-Transport responsibility of a forwarding company regarding equipping the vehicles with GPS positioning devices?

The equipment and the transmission of the GPS position are obligations of the road transport operator (i.e., the company performing the transport). The vehicle must be equipped with a fixed device or a mobile terminal/application that automatically transmits its position to the RO e-Transport system (OUG no. 41/2022, Art. 8²).

The forwarding company, acting as transport organizer, is obliged to update the vehicle data associated with the UIT code whenever changes occur (tractor unit/semi-trailer), during the validity period of the UIT, and before the start of the transport (GEO no. 41/2022, Art. 8 para. (1¹)).

Good practice / due diligence: the forwarding company should contractually and operationally ensure that the carrier initiates GPS reporting, including through:

  • explicit clauses in the transport order or contract,

  • clear instructions to the driver, and

  • start-up and signal verification checks prior to departure.
